Terms & Conditions and Liability Waiver

Welcome to Peaceful Dragon QiGong (https://peacefuldragonqigong.com/). Please read these Terms and Conditions and Liability Waiver ("Terms") carefully before registering for or participating in any online or in-person classes, workshops, private lessons, pop-up events, or accessing video programs. By purchasing a class, submitting a registration form, or participating in any activity provided by Peaceful Dragon QiGong, you agree to be bound by these Terms.
1. General Business & Identification
These Terms govern the relationship between you ("Participant", "Client", "User") and:

2. Enrollment, Payment & Chargeback Policy
Enrollment: Expressing interest or submitting a paper/online signup form indicates your commitment to enroll. Upon receipt of a secure payment link (processed via Stripe), you agree to complete the transaction promptly.
Pricing & Payment: Prices may be displayed in EUR (€) or USD ($)as specified on individual payment pages. Prices in EUR are inclusive of applicable taxes. Prices in USD are exclusive of taxes. Payments must be cleared before access to live classes, private 1-on-1 sessions, in-person events, or recorded video content is granted.
Payment Processing & Chargebacks: All credit/debit card transactions are securely handled by Stripe. Unfounded chargebacks or payment disputes initiated without first contacting Peaceful Dragon QiGong to resolve an issue will be submitted to Stripe alongside proof of these agreed Terms, class access logs, and attendance records.
3. Refunds, Cancellations & EU Right of Withdrawal
All Sales Are Final: Except as provided below, all payments for single classes, multi-class passes, online courses, in-person workshops, and pop-up events are non-refundable.
Rescheduling Policy: If you need to reschedule a booked live online session or private class, you must provide at least 24 hours' written notice before the scheduled start time. Cancellations or rescheduling requests made less than 24 hours in advance will forfeit the class fee.
In-Person Events, Outdoor Pop-Ups & Workshops
Punctuality: For in-person classes or workshops, please arrive 5–10 minutes prior to the start time. To protect the peaceful atmosphere and safety of the class, late arrivals may be denied entry without a refund.
Weather Conditions: Outdoor pop-ups or park sessions are subject to weather conditions. If an outdoor event is canceled due to severe weather, you will receive a class credit or rescheduling option.
Minimum Attendance & Event Cancellations: Peaceful Dragon QiGong reserves the right to cancel an in-person event up to 24 hours prior if minimum participant numbers are not met. In such cases, you will receive a 100% refund or the option to transfer your booking.
Travel Expenses: Peaceful Dragon QiGong is not responsible for personal travel or parking costs incurred if an in-person event is canceled or rescheduled.
EU 14-Day Right of Withdrawal (Digital Products & Live Services)
Under EU/Dutch consumer protection laws (Consumentenrecht), you have a 14-day cooling-off period for online purchases.
Digital Content (Pre-recorded Videos): By accessing, downloading, or streaming pre-recorded video content immediately after purchase, you expressly consent to immediate performance and acknowledge that you waive your 14-day right of withdrawal.
Live Online & In-Person Classes: If a live online or in-person session takes place within the 14-day cooling-off period, participating in or attending the session constitutes performance of the service, and the proportion of the service delivered is non-refundable.
4. Qigong Liability Waiver and Release of Liability
Please read this section carefully, as it affects your legal rights.
Safety and Well-being
This program is brought to you with your well-being and safety in mind. By joining any QiGong session with Peaceful Dragon QiGong - whether in-person, live online, private lessons, outdoor pop-ups, workshops, or pre-recorded video sessions - you agree to this Waiver and Release of Liability.
Medical Disclaimer & Safe Environment
When joining an online, in-person, or pre-recorded video program, you are kindly invited to ensure that you are participating in a safe, physical environment free from hazards. You agree to check with a qualified medical doctor before engaging in physical activity. If you have not checked with your doctor, you assume full responsibility to participate at your own risk and in an informed manner.
Personal Responsibility & Zone of Comfort
You are expected to stay within your zone of comfort at all times. You are invited to adapt, modify, or stop any move or posture that feels uncomfortable at any time. If you need to rest, take a break, or sit down, please do so.
During live online sessions (e.g., via Zoom), the instructor may not be able to monitor you directly due to technical limitations, camera placement, camera disablement, or gallery view size. You must exert extra caution, assume the instructor cannot see you, and remain solely responsible for moving safely within your physical limits. Engaging in exercise guided by pre-recorded videos is entirely at your own risk.
Emergency Medical Warning
By participating, you confirm that you understand the risks of physical exercise in a QiGong program and that such activities may be demanding for certain individuals. Should you feel pain, shortness of breath, chest pain, lightheadedness, dizziness, or nausea, you must STOP immediately and seek urgent medical attention (e.g., call 112 in Europe or local emergency services).
Release of Liability
You confirm that you will not hold the instructor or Peaceful Dragon QiGong personally liable for any damage, ill effect, or personal injury incurred before, during, or after any session. You release and discharge Peaceful Dragon QiGong, its owner, instructors, and managers/owners of facilities or outdoor venues where in-person or virtual sessions are held from any liability for injury, illness, or loss. You further release the instructor from all claims, demands, and causes of action arising from your voluntary participation, for yourself, your heirs, executors, and administrators.
5. Personal Property & Technical Issues
Personal Property: Peaceful Dragon QiGong is not responsible for the loss, theft, or damage of personal property during in-person sessions, outdoor pop-ups, or classes.
Technical Disruption: Peaceful Dragon QiGong is not liable for technical issues, internet outages, or equipment failures occurring on the Participant's side that prevent access to a live stream or online class. If a live class is canceled due to a technical failure on our end, the class will be rescheduled or a makeup credit will be issued.
6. Intellectual Property Rights
All materials provided by Peaceful Dragon QiGong - including live class streams, pre-recorded video content, downloadable PDFs, class structures, audio guides, logos, text, and website content - are the exclusive intellectual property of Peaceful Dragon QiGong.
You are granted a personal, non-transferable, non-exclusive license to view materials for personal practice only.
Prohibitions: You may not record, copy, reproduce, distribute, stream publicly, share access logins, or commercialize any content or video recordings without express prior written consent.
7. Class Conduct & Code of Behavior
Peaceful Dragon QiGong aims to foster a respectful, calm, and welcoming environment for all participants.
We reserve the right to immediately remove any participant from a live online or in-person class without a refund if they display abusive, disruptive, or inappropriate behavior toward the instructor or other participants.
8. Applicable Law & Dispute Resolution
Governing Law: These Terms and any agreements shall be governed by and construed in accordance with the laws of The Netherlands.
Dispute Resolution: In the event of a dispute, we encourage you to contact us directly at info [at] peacefuldragonqigong [dot] com to reach an amicable solution. If a dispute cannot be settled out of court, it shall be submitted exclusively to the competent court in the Netherlands.
EU ODR Platform: European consumers may also use the European Commission's Online Dispute Resolution (ODR) platform available at https://ec.europa.eu/consumers/odr.
